The Economic and Financial Crimes Commission (EFCC) has called on the Federal High Court in Abuja to dismiss a fundamental rights lawsuit filed on behalf of Lagos State Governor Babajide Sanwo-Olu, aimed at preventing his possible arrest or prosecution after his term ends.
In a counter-affidavit submitted on October 31, the EFCC dismissed the suit as speculative, arguing that no investigation, harassment, or threat had been made against Governor Sanwo-Olu or his aides. EFCC representative Ufuoma Ezire stated that any engagement by the agency would include clear identification and formal procedures, and denied claims of intimidating or harassing the governor’s aides.
The suit’s filing sparked controversy, as the Lagos State Government denied any involvement. Attorney General and Commissioner for Justice Lawal Pedro clarified that Sanwo-Olu, who has nearly three years remaining in office, enjoys constitutional immunity and did not authorize any legal action. "Mr. Babajide Sanwo-Olu, at no time, sued or briefed any legal practitioner to file a suit on his behalf concerning the above subject matter," read a government statement.
The EFCC reiterated it was unaware of any alleged maladministration or misuse of state funds involving Sanwo-Olu, labeling the lawsuit as “mere conjecture.” The anti-graft body also emphasized it has no intention of infringing upon the governor’s rights.
The court has adjourned the case to November 26, though there are indications that Sanwo-Olu’s lawyer, Darlington Ozurumba, may withdraw the suit.
